Acceptable use policy

What our systems and subscription services may and may not be used for.

1. Who this applies to

This policy applies to anyone using a system operated by Qelvyn LLC or subscribing to a Qelvyn service. Where we build and hand over a system that you then operate yourself, this policy applies for as long as we host or maintain it.

2. Prohibited uses

You may not use our systems or services to:

  • break any applicable law, or infringe anyone's intellectual property, privacy or other rights;
  • send unsolicited bulk messages, or any commercial message to a recipient who has not consented or has opted out;
  • distribute malware, or attempt to gain unauthorised access to any system, account or data;
  • interfere with or place a disproportionate load on infrastructure we operate, including circumventing rate limits or quotas;
  • process personal data you have no lawful basis to process, or transfer it to us for a purpose the data subjects were not told about;
  • host or distribute material that is fraudulent, deceptive, or designed to impersonate another person or organisation;
  • operate a scheme whose commercial substance is misrepresented to the people paying for it.

3. Messaging and customer contact

Several of the systems we build send messages on our clients' behalf. Where we do this, you are responsible for having a lawful basis and, where required, documented consent for every recipient, and for honouring opt-outs promptly. You are also responsible for complying with the terms of any third-party messaging platform involved. We will not configure a system to contact people who have not consented where consent is required.

4. Security research

Good-faith security research is welcome. Test only against systems you own or have written permission to test, do not access data belonging to others, and report what you find through our contact page. We acknowledge every legitimate report and will not pursue researchers who follow this section.

5. Enforcement

If we believe this policy is being breached, we will normally raise it with you first and give you a reasonable opportunity to correct it. Where a breach is serious, ongoing, or exposes third parties to harm, we may suspend the service immediately and, where the law requires it, notify the relevant authority. Suspension for a breach of this policy does not entitle you to a refund of the current period.

6. Reporting misuse

To report misuse of a Qelvyn-operated system, write to contact@qelvyn.co. For a suspected security vulnerability, write to security@qelvyn.co.
